Arrest of judgment Postponing the effect of a judgment already entered. Challenge to the array Questioning the qualifications of an entire jury panel, usually on the grounds of partiality or some fault in the process of summoning the panel. Dismissal without prejudice A dismissal which permits the plaintiff to sue again on the same cause of action or the state to proceed again. Dismissal with prejudice bars the right to subsequently bring an action on the same cause Agent one who has authority to act for another Not guilty plea Complete denial of guilt. In criminal cases, a necessary stage of the proceedings required to preserve all legal issues. Deliberation The jury's decision-making process after hearing the evidence and closing arguments and being given the court's instructions. Estate A collective term meaning all real and personal property owned by a person. Attorney of record Attorney whose name appears in the permanent records or files of a case.

	The mediation process may vary depending on the mediator. Generally, mediations commence with a general session with all parties, counsel and the mediator. At the general session, there will be a discussion of the case, the issues on appeal and other matters important to settlement. Then the mediator will meet separately with each party and their counsel in separate "caucuses." In these separate sessions, the mediator will seek to foster negotiations between the parties and develop agreement.
